Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Narratree platform (“Service”), operated by John Scrooby trading as Narratree (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Narratree is a cloud-based organisational chart tool that connects to HR systems, provides AI-assisted data import, interactive org chart visualisation, planner mode, and team management capabilities.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Accounts

To use the Service, you must sign in using a Google or Microsoft OAuth account. Each person may hold only one account. You are responsible for maintaining the security of your account and for all activity that occurs under it.

You must provide accurate, current, and complete information during the sign-up process. You agree to notify us immediately at hello@narratree.io if you become aware of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Beta Service

The Service is currently provided as a beta product. While the core features are mostly stable, you acknowledge and agree that:

  • The Service may contain bugs, errors, or inaccuracies that could affect functionality or data integrity.
  • Features may be added, modified, or removed without prior notice during the beta period.
  • We do not guarantee any specific level of uptime or availability during the beta period.
  • You should maintain your own backups of any data you upload to or create within the Service. While we take reasonable steps to protect your data, we cannot guarantee against data loss during the beta period.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use automated tools to scrape, crawl, or extract data from the Service.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Service.
  • Use the Service for any illegal, fraudulent, or harmful purpose.
  • Upload or transmit malicious content, including viruses, malware, or any code designed to disrupt, damage, or interfere with the Service.
  • Attempt to gain unauthorised access to other users’ accounts, data, or any part of the Service infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to store or process data in violation of applicable data protection laws.

6. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by Narratree and is protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

You retain full ownership of all data you upload to or create within the Service (“Your Data”). By using the Service, you grant us a limited licence to process, store, and display Your Data solely for the purpose of providing the Service to you. We will not sell, share, or use Your Data for any purpose other than delivering the Service.

7. Data and Privacy

We take the security and privacy of your data seriously. Your Data is stored in isolated, tenant-specific collections and is not accessible to other users or organisations.

When you connect an HR system (such as BambooHR or BreatheHR), we access your HR data solely to populate and synchronise your organisational chart. API credentials are stored securely and are never exposed to other tenants or third parties.

Where you use the Service to process personal data of your employees or team members, you are the data controller and we act as a data processor on your behalf. Our processing of such data is governed by our Data Processing Agreement, which forms part of these Terms. Full details of how we collect, use, and protect personal data are set out in our Privacy Policy.

8. Indemnification

You agree to indemnify and hold harmless Narratree and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your upload or processing of data through the Service that you did not have the right to upload or process.

9. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or to address security concerns. We will endeavour to provide advance notice of planned downtime where practicable.

10. Fees and Payment

The Service is currently free to use during the beta period. When pricing is introduced, we will notify you at least 30 days in advance. You will not be charged without your explicit consent. Any fees will be clearly communicated before they apply.

11. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Narratree shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you to Narratree in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty pounds (£50), whichever is greater.

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under the laws of England and Wales.

12. Termination

Either party may terminate this agreement at any time. You may stop using the Service and request deletion of your account by contacting us at hello@narratree.io.

We may suspend or terminate your access to the Service immediately if you breach these Terms, engage in conduct that we reasonably believe is harmful to other users or the Service, or if required to do so by law.

Upon termination, you will have thirty (30) days to export Your Data. After this period, we may delete Your Data in accordance with our data retention practices. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you at least thirty (30) days in advance via the email address associated with your account. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
